Welcome to Influencer Studio. These Terms and Conditions ("Terms") govern your use of our website and services, including our AI image generation tools (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

"Account" means a unique account created for you to access our Services.

4.3 Automatic Renewal

4.4 Refunds and Cancellations

You may cancel your subscription at any time. Unused subscription fees may be eligible for a refund upon cancellation. However, AI credits that have already been used are non-refundable, as they consume computing resources at the time of use. In the event of a service outage or technical issue on our end that results in lost or failed AI credit usage, we will refund or restore the affected credits at our discretion.

5. Acceptable Use

5.1 Compliance with Laws

You agree to use our Services only for lawful purposes and in accordance with these Terms. You will not use our Services in any way that violates any applicable federal, state, local, or international law or regulation.

5.2 Prohibited Activities

You agree not to:

Use our Services to create, upload, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
Impersonate any person or entity or misrepresent your affiliation with a person or entity
Attempt to gain unauthorized access to our Services, other accounts, or computer systems
Use our Services for any commercial purpose not expressly permitted by us
Engage in any data mining, scraping, or similar data gathering activities
Circumvent, disable, or otherwise interfere with any content moderation or safety features of our Services

5.3 Strictly Prohibited Content

The following types of content are strictly prohibited on Influencer Studio. Creating, uploading, sharing, or attempting to generate any of the following will result in immediate account suspension or termination, and may be reported to the appropriate authorities:

5.3.1 Deepfakes and Non-Consensual Imagery

Deepfakes: Creating AI-generated images, videos, or other media that realistically depict real individuals in fabricated scenarios without their explicit, verifiable consent. This includes but is not limited to placing a real person's likeness into situations they were never in, manipulating their appearance, or creating synthetic media intended to deceive viewers into believing the content is authentic.
Non-consensual intimate imagery: Generating or distributing sexually explicit or intimate images of any real person without their express written consent, regardless of whether the imagery is AI-generated or manipulated from real photographs.
Identity fraud: Using AI-generated content to impersonate real individuals for the purpose of fraud, deception, defamation, blackmail, or any form of manipulation.

5.3.2 NSFW and Sexually Explicit Content

Pornographic content: Generating, uploading, or sharing sexually explicit or pornographic imagery of any kind through our Services.
Sexual exploitation: Any content that depicts, promotes, or facilitates sexual exploitation of any person.
CSAM (Child Sexual Abuse Material): Any sexually explicit or suggestive content involving minors. This is an absolute zero-tolerance policy. Any such content will be immediately reported to law enforcement, including the National Center for Missing & Exploited Children (NCMEC) or equivalent authorities in the applicable jurisdiction.
Sexualized depictions of minors: Any content that sexualizes or depicts minors in a suggestive, romantic, or inappropriate manner, regardless of whether it is AI-generated or real.

5.3.3 Violence and Harmful Content

Graphic violence: Content depicting extreme gore, torture, mutilation, or gratuitous violence.
Terrorism and extremism: Content that promotes, glorifies, or incites terrorism, violent extremism, or acts of mass violence.
Self-harm: Content that promotes, encourages, or provides instructions for self-harm or suicide.

5.3.4 Misinformation and Deception

Disinformation: Using our Services to create content intended to spread false or misleading information, particularly regarding public health, elections, or civic events.
Fraudulent impersonation: Creating AI-generated content that impersonates public figures, brands, organizations, or government entities for the purpose of deception or fraud.
Fake evidence: Generating content intended to be used as fabricated evidence in legal, journalistic, academic, or official contexts.

5.3.5 Hate Speech and Discrimination

Content that promotes hatred, discrimination, or violence against individuals or groups based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or any other protected characteristic.

5.3.6 Other Prohibited Uses

Using our Services to facilitate any form of harassment, bullying, stalking, or intimidation.
Generating content that infringes on the intellectual property rights of others.
Creating content designed to manipulate or exploit vulnerable individuals.
Any use that violates applicable export control, sanctions, or trade compliance laws.

5.4 AI Image Generation Guidelines

When using our AI image generation tools, you additionally acknowledge and agree that:

All generated content must comply with the prohibited content policies outlined in Section 5.3 above.
You are solely responsible for ensuring that any content you generate does not violate the rights of any third party.
AI-generated content depicting identifiable real individuals requires verifiable consent from those individuals.
You will not use AI-generated content to mislead others into believing the content is an authentic, unaltered photograph or video.
You will clearly label or disclose AI-generated content as such when sharing it publicly, particularly in contexts where viewers may reasonably believe the content is real.
We employ automated content moderation systems and reserve the right to block, flag, or remove content that our systems identify as potentially violating these policies.

5.5 Enforcement and Consequences

We take violations of these policies seriously. Depending on the severity and nature of the violation, we may take one or more of the following actions:

Warning: Issuing a formal warning for minor or first-time violations.
Content removal: Removing or disabling access to the offending content.
Account suspension: Temporarily suspending your account and access to our Services.
Account termination: Permanently terminating your account without refund.
Legal action: Pursuing civil or criminal legal remedies.
Law enforcement referral: Reporting violations to the appropriate law enforcement agencies, particularly in cases involving CSAM, threats of violence, or other criminal activity.

We reserve the right to take any of these actions at our sole discretion, without prior notice. We may also cooperate with law enforcement investigations and legal proceedings related to your use of our Services.

6. Intellectual Property Rights

6.1 Our Intellectual Property

The Services and their original content (excluding Content provided by users) are and will remain the exclusive property of Influencer Studio and its licensors.

6.2 Your Content

You retain ownership of the Content you create using our Services, subject to the licenses granted below.

6.3 Licenses

By uploading or creating Content through our Services:

You grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such Content for the purpose of providing and improving our Services
For AI-generated images, you acknowledge that while you own the output, we retain rights to the underlying AI models and technology

6.4 Feedback

If you provide us with feedback about our Services, you grant us the right to use that feedback without restriction.

7. User Content and Conduct

7.1 Content Responsibility

You are solely responsible for the Content you upload or generate using our Services.

7.2 Content Monitoring

We do not actively monitor user Content but reserve the right to review and remove any Content that violates these Terms.

7.3 Copyright Infringement

If you believe that your work has been copied in a way that constitutes copyright infringement, please contact us with information specified in our Copyright Policy.

8. Disclaimers and Limitations of Liability

Our Services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied.

8.2 Limitation of Liability

To the maximum extent permitted by law, in no event shall Influencer Studio be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our Services.

8.3 AI Generation Limitations

You acknowledge that AI image generation is an evolving technology with inherent limitations and may not always produce the expected results.

You agree to indemnify, defend, and hold harmless Influencer Studio and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of our Services or violation of these Terms.

10. Termination

You may terminate your account at any time by following the instructions on our website.

We may terminate or suspend your account and access to our Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.
